This notice sets out the rules for the processing of data by Scope Fluidics S.A. in connection with your application for the Scope Fluidics Fellowship programme (you will find the programme terms and conditions on Scope Fluidics S.A. website). The Company will process your personal data for the purpose of taking actions prior to entering into a contract, i.e. conducting recruitment for the Scope Fluidics Fellowship programme, as well as for its legitimate interests for the purpose of verifying your qualifications and skills, and to the extent that you also provide optional data the legal basis for the processing is your consent.
Your data may be processed in an automated manner or in paper form.
The terms below have the following meanings:
“Company” – Scope Fluidics Spółka Akcyjna with its registered office in Warsaw, ul. Ogrodowa 58, entered in the Register of Entrepreneurs of the National Court Register kept by the District Court for the Capital City of Warsaw in Warsaw, 14th Commercial Division of the National Court Register under KRS number: 0000668408, NIP: 5272645989, share capital of PLN 272,593.00 paid up in full.
“Scope Fluidics Group” – a group formed by the Company and its affiliates. Due to the pursuit of certain common goals, these companies are in a co-controllership relationship with each other; the scope of this relationship and related responsibilities are defined in the Personal Data Protection Policy adopted and operating in the Scope Fluidics Group.
This notice is provided in accordance with Article 13 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation – “GDPR”).
Controller and co-controller of personal data
The Company is the controller of the personal data specified in this notice for the purposes of the recruitment process regarding the Scope Fluidics Fellowship programme. The data specified in this notice is also co-controlled by the other Scope Fluidics Group companies for the purposes of achieving the common goal of optimising the use of human resources. Categories of personal data and legal bases for the processing
The Company processes the following categories of personal data:
· personal data collected in the application form, e.g. identification data (forename and surname), contact details (phone number and address), data on qualifications and experience, necessary to take actions prior to entering into a contract, i.e. to carry out recruitment for the Scope Fluidics Fellowship programme and to pursue the Company’s legitimate interests, i.e. to verify your qualifications and skills;
· other data that you choose to provide, if you give your consent which can be revoked at any time, by including such data in the application documents, including, for example, your image;
· all the above-mentioned data for the purpose of future recruitments, if you give your consent which can be revoked at any time.
Purpose of the processing
The Company processes personal data in particular for the following purposes:
· carrying out the recruitment processes regarding the Scope Fluidics Fellowship programme;
· carrying out future recruitments, if you give your consent which can be revoked at any time.
Data disclosure and Data Recipients
Access to your data will only be granted to the extent necessary to fulfil the purposes of the Company as indicated in this notice. The Company may disclose your personal data in particular to the following entities (“Data Recipients”):
· subcontractors, providers that render services to the Company (such as accounting firms, owner/manager of the building where the Company’s seat is located, auditing firms, law firms, IT service providers, data hosting providers, software providers, benefits providers); the Company will exercise due care when selecting such providers and will require them to apply appropriate technical and organisational security measures to protect the data provided;
· recipients to whom the Company must disclose personal data under an order issued by a public authority or under legal provisions;
· other recipients, if necessary and reasonable, such as other companies from the Scope Fluidics Group, potential investors, intellectual and industrial property rights registration authorities, research centres, medical entities, recipients of documents as part of the reporting obligations of a public company.
Transfer of data to third countries
As a rule, your personal data will be processed in Poland and within the European Economic Area (EEA). In situations where data needs to be transferred outside the EEA in order to fulfil the purposes of the processing, the Company will ensure that such transfer takes place in accordance with the applicable regulations and using necessary safeguards. This may occur in particular if Data Recipients are based outside the EEA or if they depend on an entity based outside the EEA.
Your rights towards the Company
You have a right to:
· request access to and a copy of your personal data; however, this right may be subject to certain restrictions, in particular in the case of repeated requests in short intervals,
· request the rectification, completion or updating of your personal data,
· request the restriction of the processing of your personal data to only strictly necessary activities,
· request the erasure of data; however, this right is subject to certain restrictions, including when other regulations (e.g. tax regulations) require the Company to continue the processing,
· object to the processing of your personal data for legitimate interests, provided that this does not conflict with the Company’s data protection and security obligations,
· lodge a complaint to the supervisory authority (President of the Data Protection Office, ul. Stawki 2, 00-193 Warsaw) and to use an effective judicial remedy – if you believe that your rights have been breached.
The Company is responsible for the implementation of all the above rights. The other co-controllers are obliged to support the Company.
Security
The Company takes measures to protect personal data against unlawful destruction, loss, alteration, unauthorised disclosure or unauthorised access. Appropriate technical and organisational measures have been taken to protect the systems in which personal data is stored, as well as to protect personal data processed in a traditional paper-based manner. The Company also requires service providers to comply with the GDPR obligations and to protect personal data in accordance with the provisions of relevant agreements.
Data processing period
Your personal data will be processed for as long as it is necessary to achieve the purpose for which it was collected or another legally permissible purpose, at least for the duration of the recruitment process regarding the Scope Fluidics Fellowship programme and thereafter for a period required or permitted under applicable legal provisions or until the revocation of your consent if consent is the legal basis for the processing, or until you effectively object to the processing of your personal data.
Automated decision-making and profiling
Your personal data will not be used for automated decision-making or profiling.
