    1. Information clause for candidates 

      1. Pursuant to Article 13 and Article 14 of the GDPR, we inform you that in the case of recruitment processes conducted for positions within companies belonging to the Contrain Capital Group, the joint controllers of your personal data may be the companies belonging to this group that participate in a given recruitment process, namely: Contrain Group S.A. with its registered office at ul. 3-go Maja 14a, 93-408 Łódź, Contrain Poland sp. z o.o. with its registered office at ul. 3-go Maja 14a, 93-408 Łódź, Contrain sp. z o.o. with its registered office at ul. 3-go Maja 14a, 93-408 Łódź, and Contrain Global sp. z o.o. with its registered office at ul. 3-go Maja 14a, 93-408 Łódź („Group Companies”). 

      In the case of recruitment processes conducted by Contrain Global sp. z o.o. on behalf of entities outside the Contrain Capital Group, the controller of your personal data is Contrain Global sp. z o.o., ul. 3-go Maja 14a, 93-408 Łódź.

      1. This clause applies to the processing of candidates' personal data in connection with: 

      1. recruitments conducted for companies belonging to the Contrain Capital Group; 

      1. recruitments conducted by Contrain Global sp. z o.o. as part of job placement services for its clients; 

      1. maintaining a candidate database for the purposes of future recruitment processes.

       

      1. Own recruitment of companies from the Contrain Capital Group 

      If you apply for a position in one of the Group Companies, your personal data is processed for the purpose of conducting the recruitment process, assessing qualifications, experience, and competences, contacting you regarding the recruitment, and selecting the person best meeting the requirements of the position. 

      The legal basis for data processing is: 

      1. Article 6(1)(c) of the GDPR in conjunction with Article 22¹ of the Labour Code – regarding data required from a person applying for employment; 
      2. Article 6(1)(a) of the GDPR – regarding additional data provided voluntarily by the candidate, exceeding the scope required by legal provisions;

        c. Article 6(1)(a) of the GDPR – in the case of granting separate consent to participate in future recruitments conducted by the Group Companies;

        d. Article 6(1)(f) of the GDPR – to the extent that processing is necessary for the establishment, exercise, or defence of legal claims, or to demonstrate the correctness of the conducted recruitment process. 

         
        1. Recruitment conducted by Contrain Global sp. z o.o. on behalf of a client 

         

        If you participate in recruitment conducted by Contrain Global sp. z o.o. on behalf of a client, your personal data is processed for the purpose of participating in the given recruitment process, assessing whether your qualifications and experience meet the requirements of the position, contacting you regarding the recruitment, presenting your candidacy to the client, and managing the recruitment process 

        The legal basis for processing data in this case is: 

        1. Article 6(1)(a) of the GDPR – the candidate's consent to participate in a given recruitment procedure conducted for a client; 

        1. Article 6(1)(a) of the GDPR – the candidate's consent to the processing of data contained in the CV, application form, correspondence, and other documents submitted in connection with the recruitment; 

        1. Article 6(1)(a) of the GDPR – the candidate's consent to transfer personal data to the client of Contrain Global sp. z o.o. as a potential employer; 

        1. Article 6(1)(a) of the GDPR – in the case of granting separate consent to participate in future recruitments conducted by Contrain Global sp. z o.o. on behalf of its clients; 

        1. Article 6(1)(f) of the GDPR – to the extent that processing is necessary for the establishment, exercise, or defence of legal claims, or to demonstrate the correctness of the conducted recruitment process. 

         

        In the case of blind recruitment, the identity of the client may not be disclosed to the candidate at the initial stage of the process. However, the candidate's data will not be transferred to the client before the client's identity is disclosed to the candidate and before obtaining the candidate's consent to transfer their personal data to the client. 

         

        The client of Contrain Global sp. z o.o. becomes an independent controller of personal data from the moment of receiving the candidate's data. The client is independently responsible for further data processing within their own recruitment process and for fulfilling their obligations under the GDPR.  

         
        1. Withdrawal of consent 

         

        To the extent that your personal data is processed based on consent, you have the right to withdraw it at any time. However, the withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal. 

        The withdrawal of consent also does not affect the possibility of further processing of your personal data to the extent that the basis for its processing is another ground resulting from the provisions of the GDPR. 

        1. The recipients of your personal data may be: 

        1. companies belonging to the Contrain Capital Group participating in the recruitment process as joint data controllers or conducting future recruitment processes for which the candidate has given consent; 

        1. clients of Contrain Global sp. z o.o. on whose behalf recruitment processes are conducted; 

        1. entities providing IT, hosting, postal, telecommunications, administrative, legal, accounting, auditing, or advisory services to the Group Companies; 

        1. providers of recruitment systems, ATS, CRM, communication tools, video calling tools, competency tests, and application forms; 

        1. subcontractors supporting recruitment processes; 

        1. entities authorised to obtain data on the basis of legal provisions. 

        1. Data retention period: 

        1. data processed for the purposes of a specific recruitment will be stored for the duration of the recruitment process and for a period of 3 months from its completion; 

        1. data processed based on consent to participate in future recruitments will be stored for a period of 24 months from the date consent was granted, unless the consent is withdrawn earlier;

        2. after the expiry of the indicated periods, personal data may still be processed solely to the extent necessary to fulfil the legitimate interests of the controller or joint controllers involving the establishment, exercise, or defence of claims related to the conducted recruitment processes. 

          1. Voluntary provision of data: 

          1. providing data is voluntary, but it may be necessary to participate in the recruitment process. 

          1. in the case of recruitment conducted by the Group Companies based on an employment contract, providing data required by labour law provisions is necessary to consider the candidacy. 

          1. providing additional data is voluntary; the lack of consent to its processing will not be a ground for unfavourable treatment of the candidate, but it may limit the possibility of taking this information into account in the recruitment process. 

          1. the lack of consent to participate in future recruitments does not affect participation in the current recruitment. 

          1. the lack of consent to transfer data to a client of Contrain Global sp. z o.o. may prevent the presentation of the candidacy to that client. 

           

           

          1. Automated decision-making 

           

          Candidates will not be subject to decisions based solely on automated processing, including profiling, which would produce legal effects concerning them or similarly significantly affect them. 

           

           

          1. Data transfer outside the EEA 

           

          As a general rule, your personal data will not be transferred outside the European Economic Area (EEA). If, however, in connection with the use of specific IT tools, recruitment systems, cloud services, e-mail, or other technical solutions, a need arises to transfer data to a third country or an international organisation, such transfer will be carried out in compliance with the requirements specified in the GDPR and applying appropriate safeguards, in particular based on an adequacy decision, standard contractual clauses adopted by the European Commission, or other mechanisms provided for by the GDPR. 

          1. You have the right to: 

          1. access your personal data. 

          1. obtain a copy of the data. 

          1. rectify the data. 

          1. erase the data  

          1. restrict processing. 

          1. data portability, if the processing is based on consent and carried out by automated means. 

          1. object to data processing based on Article 6(1)(f) of the GDPR. 

          1. withdraw consent at any time. 

          1. lodge a complaint with the President of the Personal Data Protection Office 

           

    Consents
